Gina Ko, an attorney at Reinisch Wilson, and Knowrasa Patrick, Program Manager for the Washington State Department of Labor & Industries Self Insurance Program, discuss the Department of Labor and Industries’ new rules as of December 2023.

While the LNI was still in the rulemaking process at the time of the presentation, Program Manager Patrick was able to discuss both the anticipated direction of the rules and probable penalty exposures for self-insured municipal employers with the implementation of the state’s new good faith and fair dealing statutes, starting with an audit process and warning letters in early 2024.

LNI’s new rules will go into effect on July 1, 2024, and are anticipated to have a major impact on self-insured municipal employers. Ms. Ko and Program Manager Patrick also explore LNI’s thoughts on the direction of good faith and fair dealing and enforcement of various penalty provisions through a comedic dialogue that (hopefully) interjects some humor into an otherwise serious update.

Gina Ko (she/her) is a senior associate in the firm’s Washington practice group. Her practice focuses on representing self-insured employers, and the occasional State Fund employer, in addressing workers’ compensation and adjacent employment law issues in Washington State.

The Honorable Knowrasa Patrick is a former judge with the Board of Industrial Insurance of Appeals, and currently the Program Manager for the Washington State Department of Labor & Industries’ Self Insurance Program.
